Once your property goes under offer, our legal team will negotiate the terms of the legal contract (known as the missives) and take care of the conveyancing process, ensuring that you receive the best possible advice and guidance. What legal fees do I need to consider for purchasing?

Aside from the purchase price of the property, there are other expenses which you will need to consider, such as legal fees, registration fees and Land and Buildings Transaction Tax.

Each house purchase is different and the associated expenses will vary, mainly depending on the purchase price. Get in touch and we’ll be very happy to offer you a transparent and competitive quote.

What legal fees do I need to consider for selling?

As with purchasing a property, the legal fees and associated expenses for selling your property will vary depending on a few factors. The usual expenses will be the Legal and Local Authority searches, the registration dues of an Advance Notice with Registers of Scotland and the registration dues of a Discharge if you have a mortgage secured against your home. If you purchased your property before 2003 we may also have to obtain a Plans Report and possibly a new title deed plan.

Can you act for me in the purchase or sale of property which is not located in Orkney?

Yes, we would be very happy to assist you in the purchase or sale of any property which is located in Scotland.

Do you provide other legal services?

Can you act for me in the purchase of a property advertised by Harcus Property?

Unfortunately the Law Society of Scotland’s Conflict of Interest rules do not permit the the same solicitor to act for both the seller and purchaser of the same property. However, whilst we will usually be acting on behalf of the seller of a property which is advertised by us, that is not always the case. Get in touch and we’ll be happy to check and confirm whether we are able to act for you in your potential purchase.
